1. Scope of Application
The following General Terms and Conditions apply to all orders placed through our online shop. Our online shop is exclusively aimed at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or independent professional activity when entering into a legal transaction.
2. Contracting Party, Conclusion of Contract, Correction Options
The purchase agreement is concluded either with M4U Fashion GmbH or, if you order Noodosz partner goods (Shopify Collective), you will have – depending on the product you choose – either an agreement solely with the respective Noodosz partner or with both M4U Fashion GmbH and the respective Noodosz partner (joint seller). Information about the respective contractual relationship will be displayed on each page describing the product details.
By placing an order on the Noodosz website, you declare that you are acting exclusively for private purposes. Your contracting party is either M4U Fashion GmbH or the respective Noodosz partner, depending on the type of products you order. The contract becomes effective by clicking the purchase button and receiving the order confirmation. We reserve the right to refuse or cancel orders generated by automatic programs or third-party services.
3. Contract Language, Storage of Contract Text
The language(s) available for the conclusion of the contract is German.
We store the contract text and send you the order data and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the Internet.
4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. You can find more details about the amount of shipping costs with the offers.
We deliver only by shipment. Unfortunately, self-collection of the goods is not possible. Our partners in the Shopify Collective program on noodosz.com may use different transport companies.

The goods remain our property until full payment has been made.
7. Transport Damage
If goods are delivered with obvious transport damage, please complain about such defects to the deliverer as soon as possible and please contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.
8. Warranty and Guarantees
8.1 Liability for Defects
The statutory liability for defects applies.
8.2 Guarantees and Customer Service
Information on any additional guarantees and their exact conditions can be found with the product and on special information pages in the online shop.
9. Liability

- in case of injury to life, body or health,
- in case of intentional or grossly negligent breach of duty,
- in case of guarantee promises, if agreed, or
- insofar as the scope of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, our liability is limited in amount to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.
